1.1 These Terms and Conditions (Terms) govern your access to and use of services provided by In The Black Network, Inc. (Company,we,our, or us).
1.2 These Terms apply to all users, including those accessing content via AVOD (Ad-supported Video on Demand) and TVOD (Transactional Video on Demand).
1.3 By accessing or using the Company Services, you agree to be bound by these Terms and our Privacy Policy.
2.1 We offer streaming through both AVOD and TVOD models.
2.2 AVOD allows you to access content without payment in exchange for viewing advertisements.
2.3 TVOD provides access to content on a rental or purchase basis, typically requiring payment.
2.4 Additional transaction-specific terms may apply at the point of content purchase or access.
3.1 You may be required to register for an account to access some features.
3.2 You agree to provide accurate and complete information and to keep it current.
3.3 You are responsible for maintaining the confidentiality of your login credentials.
3.4 Use of the Services is limited to those 13 years and older.
4.1 We grant you a limited, revocable, non-exclusive, non-transferable license to access content for personal, non-commercial use.
4.2 You may not reproduce, distribute, publicly perform, or create derivative works from our content unless expressly authorized.
4.3 All intellectual property rights are retained by the Company and licensors.
5.1 You retain rights to any content you submit or post.
5.2 By submitting content, you grant us a non-exclusive, perpetual, irrevocable, worldwide license to use and display it.
5.3 You agree not to post unlawful, harmful, or infringing content.
5.4 We reserve the right to remove content that violates these Terms.
6.1 We respect the intellectual property rights of others.
6.2 If you believe your work has been copied or used in a way that constitutes infringement, you may submit a DMCA notice to support@intheblacknetwork.tv.
6.3 Your notice must comply with the requirements set forth in 17 U.S.C. 512(c)(3).
7.1 Our AVOD services include advertising, and your data may be used to personalize ads.
7.2 We may work with third-party vendors for analytics and ad targeting.

8.1 Our services are hosted on Microsoft Azure Cloud.
8.2 Microsoft is not a party to these Terms and disclaims liability for service performance.
8.3 We remain responsible for platform uptime and data handling under our Azure configuration.
9.1 We may suspend or terminate access at our discretion, including for violations of these Terms.
9.2 We may update, modify, or discontinue features without prior notice.
10.1 You agree to indemnify and hold harmless the Company and its affiliates from any claims or damages arising from your use of the Services or breach of these Terms.
11.1 Any dispute arising out of these Terms shall be resolved through binding arbitration administered by JAMS in accordance with its rules.
11.2 You waive any right to trial by jury or participation in a class action.
11.3 This arbitration clause survives termination of your use of the Services.
12.1 To the fullest extent permitted by law, the Company shall not be liable for indirect, incidental, or consequential damages.
12.2 Our total liability shall not exceed the greater of $100 or the amount you paid to us in the past 12 months.
13.1 These Terms shall be governed by the laws of the State of California.
13.2 Venue for disputes not subject to arbitration shall be in Los Angeles, California.

From time to time this service may let you open a separately branded application operated by one of our affiliates or partners (each, an "Affiliate App") from within this service. You will always start this experience yourself by selecting a link or button — we do not open an Affiliate App for you automatically.
Although an Affiliate App may open without closing this service or switching your device, it is a separate service operated by a separate company. We do not own, operate, or control the Affiliate App, and making it available to you does not mean that we endorse it or that we are responsible for it. The company that owns the Affiliate App is not our agent, and we are not theirs.
An Affiliate App may also provide a way to return to the service you came from. Using it returns you to that separate service, which is governed by its own terms and privacy policy — the Affiliate App's terms no longer apply once you leave it.
Each Affiliate App has its own terms of service and privacy policy, which govern your use of that app and any information it collects once you enter it. We are not responsible for the content, products, services, data practices, or conduct of any Affiliate App, and to the fullest extent permitted by law we exclude liability for them. You should review the Affiliate App's terms of service and privacy policy before using it. You can find them inside the Affiliate App in the same way you found these terms — through that app's navigation menu.
Any account, subscription, purchase, or other transaction you make in an Affiliate App is handled by, and is the responsibility of, the company that owns that app under its own terms — not through this service.
We may add, change, or remove Affiliate Apps at any time without notice.
This section applies in both directions. Each company that makes its application available through this launch experience acts as a parent service when it offers a link to another app, and as an Affiliate App when its application is opened from another service. The terms in this section apply to that company in either role.
