MOTORVISION TV with, among others, the products "FREE" and "PREMIUM", (together also "MOTORVISION TV") is an offer of
MV International GmbH,
Bahnhofstrasse 20b,
8272 Ermatingen, Switzerland
("MV International")
for the contents of the TV stations of German Car TV Programm GmbH, Thalkirchner Strasse 56, 80337 Munich, Germany and MV International (the stations "MOTORVISION TV") hereinafter referred to as "TV Station") and for other moving image contents.
These terms and conditions of use apply to the use of all MOTORVISION TV products and govern the services to be provided by MV International as well as the powers and obligations of the customers of these services ("customer").
The product FREE can be used by customers free of charge. MV International reserves the right to limit the number of videos that can be accessed free of charge per device or customer or the duration of their use.
The "PREMIUM" product bundles the TV stations' media libraries and their TV live streams (where available) as well as other moving image content and makes them available to customers for download for a fee, if necessary after a free test phase has expired. Content is available for the most part in HD quality. The offer is not free of advertising.
The details of the paid purchase / subscription of the "PREMIUM" offer are listed in Section 3 "Contract".
Registered customers receive the MOTORVISION TV NEWSLETTER from MV International by e-mail as an exclusive benefit. This newsletter informs regularly about selected advantages for MOTORVISION TV customers. In addition, it contains favorites and customized tips, as well as program information and news. Customers can unsubscribe from MOTORVISION TV Insider at any time. An unsubscribe option can be found in every MOTORVISION TV Insider e-mail or in the customer account when logged in.
It is also possible to subscribe to MV International's personalized (advertising) news, which includes the MOTORVISION TV newsletter. These news items contain information about the MOTORVISION TV offer, vouchers and surveys.
An unsubscribe option can be found, among other things, in every e-mail or in the member area when logged in.
Customers can receive personalized or general push messages around MOTORVISION TV, if they have agreed on the respective device.
Further details on the respective products, notice periods, as well as the current content and functionalities can be found at https://app.motorvision.tv/product.
The use of "MOTORVISION TV" can only be made possible by MV International if the system used by the customer meets certain requirements. The currently valid technical requirements under which the products can be used can be found at https://app.motorvision.tv/howitworks.
If the end device or system used by the customer does not meet the requirements listed there, the use of MOTORVISION TV may not be possible or may be limited.
In such cases, no refund of the technical access fee and the subscription price will be made. Please inform yourself before signing a contract.
The use of some MOTORVISION TV products is only possible after registration and conclusion of a corresponding contract. The details of the conclusion of the contract are regulated in clause 3.
The customer is obligated to provide all information in the context of the registration truthfully. The customer account will be linked to the e-mail address provided. The customer himself is responsible for ensuring that he has access to his e-mail account and that he knows with which e-mail address he has registered.
MV International is entitled to reject individual registrations even without giving reasons.
Personalized contract processing, such as the sending of invoices or notices of contract changes, is carried out via the e-mail address provided by the customer. The customer himself is responsible for regularly checking his e-mail account for e-mails. Sending within the scope of contract communication is only carried out to e-mail addresses that have been confirmed by the customer during the registration process.
Registration is possible from the age of 16. You must be at least 18 years of age or of legal age to order our chargeable offers (e.g., Premium). Minors may only use our offers under the supervision of an adult.
The content offered on MOTORVISION TV is subject to licensing restrictions. Not all content is available from every country. You can view content from our offerings primarily in the country where you created your profile and only in geographic locations where we offer our service and have licensed such content. The content that may be available for viewing varies by geographic location and may change from time to time. The number of devices on which you can view simultaneously depends on your chosen subscription and is specified on the Profile page.
By completing the registration process (including the e-mail validation process) and clicking the "Buy" button, the customer makes an offer to MV International to enter into a corresponding contract for the purchase of a MOTORVISION TV product by subscription. MV International may accept this offer by sending an e-mail to the e-mail address provided by the customer during the registration process. In this case, MV International will send the customer a confirmation of the contract concluded including the relevant information. A corresponding invoice will also be sent to the e-mail address.
Not included in the fee are costs incurred by the customer in connection with the use of "MOTORVISION TV" due to services provided by third parties, i.e. in particular costs for the use of end devices and Internet connections. These costs are to be borne by the customer themselves.
Unless otherwise agreed, the contract has a minimum term of one month. Thereafter, it shall be automatically renewed for a further month in each case unless it is terminated by one of the parties.
Unless otherwise agreed, a cancellation is possible at any time with a notice period of 30 days. Cancellation can be made, for example, by e-mail, stating the e-mail address to which the subscription is booked, and via the customer account. The right to extraordinary termination for good cause remains unaffected. An important reason is particularly given if a due payment has not been made by the customer.
The product "PREMIUM" can only be booked from selected countries for licensing reasons. The content of the offer may vary or be limited depending on the respective country of residence.
If you take out a paid subscription, you have the following right of withdrawal:
You have the right to cancel this contract within fourteen days without giving reasons. The revocation period is fourteen days from the date of conclusion of the contract.
In order to exercise your right of revocation, you must inform MV International GmbH, Bahnhofstrasse 20b, 8272 Ermatingen, Switzerland, or by fax: 004989122281499, or by e-mail: support@motorvision.com by means of a clear statement (e.g. a letter, fax or e-mail sent by post) of your decision to revoke the contract.
In order to comply with the revocation period, it is sufficient that you send the notification of the exercise of the right of revocation before the end of the revocation period.
If you revoke this contract, we must refund all payments we have received from you, including delivery costs (with the exception of additional costs resulting from the fact that you have chosen a different type of delivery than the cheapest standard delivery offered by us), immediately and at the latest within fourteen days from the day on which we receive notification of your revocation of this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged for this repayment.
MV International reserves the right to adjust the price of a subscription if the product scope changes or our operating costs increase. Factors in this regard may include increased costs for the production and licensing of our content, for maintaining the technical operation of our platforms and in the area of personnel and infrastructure (e.g. increased rental costs), as well as increased government charges. MV International will inform the affected customers about a planned adjustment at least 8 weeks in advance by e-mail to the e-mail address provided. If the customer does not terminate the contract in due time before the date of the price adjustment notified to him, the adjusted price notified shall be deemed to be agreed from this date.
The fee for the respective subscription is due in advance. We reserve the right to invoice on a pro rata basis (usually monthly), so that in particular the first and the last invoice can be made on a pro rata basis.
You can change your payment method by visiting our website and clicking on the "Profile" link. If a payment was not successfully paid due to expiration, insufficient funds or other reasons, and you do not change your payment method or cancel your profile, we may suspend your access to the Service until we have received a valid payment method. If you update your payment method, you authorize us to continue charging for the updated payment method and you will remain responsible for any uncollected amounts. This may result in a change in your payment billing information. For some payment methods, the issuer of your payment method may charge you certain fees, such as a transaction fee abroad or other fees related to the processing of your payment method. Local tax charges may vary depending on the payment method used. Check with your payment method provider for details.
If the customer chooses direct debit as payment method, he/she hereby gives MV International a SEPA basic mandate. The direct debit will be collected one day after the invoice date. The period for pre-notification is reduced to one day. The customer assures to provide for the coverage of the account. All costs arising from a non-redemption or a reversal of the direct debit shall be borne by the customer, unless the non-redemption or reversal was caused by MV International.
Some customers have the possibility to use the product "PREMIUM" for a limited time free of charge. The details and especially the respective duration of the free test phase will be pointed out on the website and when booking. The number of free test phases is limited to one per customer. The offer is only valid for new customers who have not yet received a free test phase.
The customer is entitled to register on up to 3 different mobile devices. All video files and TV live streams are provided with a Digital Rights Management ("DRM"), which limits the number of simultaneous streams and may impose further usage restrictions (e.g. territorial, temporal). The customer is obliged not to change, remove or circumvent the DRM. Further information on DRM can be found under "Digital Rights Management".
The customer is authorized to use "MOTORVISION TV" exclusively in the private sector and may use the content offered there only for personal and non-commercial purposes. A public performance of any kind is not permitted.
The video files and TV live streams are protected by copyright and may not be reproduced, edited or passed on to third parties without the consent of MV International and the TV stations.
The customer is not entitled to transfer the contractual relationship to other natural and/or legal persons or not to allow or enable them to use his access. The customer is responsible for keeping his access data, including the password, secret.
The customer is obligated not to copy the video files and TV live streams contained in "MOTORVISION TV", to pass them on to third parties and in particular to place them in file-sharing networks or to offer them publicly or make them publicly accessible in any other way, in particular not via websites, blogs, video portals or the like Irrespective of this, the sharing of links via social media (e.g. Facebook or Twitter) is permitted using the functions provided for this purpose in the context of "MOTORVISION TV".
The customer is obliged to show children or young people only such contents from "MOTORVISION TV" or to make them accessible in any other way, which are released for the respective age group.
Contents which are not suitable for children and/or young people of different age groups are marked with technical age labels, thus creating the prerequisites for the sensible use of a youth protection program recognized by the responsible authorities.
MV International reserves the right to block customers from using "MOTORVISION TV" with immediate effect in the event of violations of the regulations listed in sections 4.1 and 4.2. The same shall apply in the event of a delay in payment.
In this case, any fees already paid will be forfeited and will not be refunded. After payment of the fee, the block can be lifted again.
MV International makes no warranty or representation that MOTORVISION TV will meet the requirements of its customers, or that it will be uninterrupted, secure or error-free. MV International reserves the right - particularly for legal reasons - to remove individual video files from "MOTORVISION TV" at any time and/or to blacken them in the TV live stream or replace them with other content.
MV International and the TV stations are liable for damages in the case of culpable injury to life, body or health as well as in cases of intentional or grossly negligent acts according to the legal regulations.
The liability of MV International and the TV broadcasters for damages caused by slight negligence is limited to essential contractual obligations, i.e. those obligations whose fulfilment is essential for the proper execution of the contract, whose non-fulfilment would endanger the purpose of the contract and on whose fulfilment the user regularly relies.
Changes to these General Terms of Use will be communicated to the customer in an appropriate manner, e.g. by e-mail. If the customer objects to the changes within 14 days after notification, the General Terms of Use valid at the time of the conclusion of the contract shall remain valid until the respective contractual relationship ends. If the Customer does not object to the changes within a period of 14 days after notification, the changed General Terms and Conditions of Use shall become effective from this point in time and shall be decisive for the contractual relationship from this point in time.
The respective General Terms of Use of the payment service provider selected by the customer shall apply in addition to the provisions made here.
If the customer has booked the subscription via an App Store, e.g. from Amazon, Google or Apple, their differing terms and conditions shall apply in addition. The contractual relationship then exists between the customer and the store provider.
German law shall apply to the exclusion of UN sales law. The possible invalidity of individual provisions of these General Terms of Use shall not affect the validity of the remaining provisions.

Diese Nutzungsbedingungen finden für die Nutzung aller Produkte von MOTORVISION TV Anwendung und regeln die von MV International zu erbringenden Leistungen sowie die Befugnisse und Pflichten der Kunden dieser Angebote („Kunde“).
Das Produkt FREE kann von Kunden kostenlos genutzt werden. MV International behält sich vor, die Anzahl an pro Gerät oder Kunde kostenlos abrufbaren Videos oder die Dauer deren Nutzung zu begrenzen.
Das Produkt „PREMIUM“ bündelt die Mediatheken der TV-Sender und deren TV Live-Streams sowie weiterer Bewegtbildinhalte und stellt diese den Kunden, ggf. nach Ablauf einer kostenlosen Testphase, gegen ein Entgelt zum Abruf zur Verfügung. Inhalte stehen zum Großteil in HD-Qualität zur Verfügung. Das Angebot ist nicht werbefrei. Die Einzelheiten zum kostenpflichtigen Erwerb des Angebots „PREMIUM“ sind in Ziffer 3 „Vertrag“ aufgeführt.
Registrierte Kunden erhalten von MV International per E-Mail als exklusiven Vorteil den MOTORVISION TV NEWSLETTER. Dieser informiert regelmäßig über ausgesuchte Vorteile für MOTORVISION TV Kunden. Zudem enthält er Favoriten-Hinweise und maßgeschneiderte Tipps, sowie Programm-Infos und News. Kunden können sich jederzeit vom MOTORVISION TV Insider abmelden. Eine Abmeldemöglichkeit findet sich u.a. in jeder MOTORVISION TV Insider-E-Mail oder im Kundenkonto im eingeloggten Zustand.
Es besteht zudem die Möglichkeit, sich für personalisierte (werbliche) Nachrichten, welche auch den MOTORVISION TV Newsletter umfassen, von MV International anzumelden. Diese Nachrichten enthalten Informationen rund um das Angebot von MOTORVISION TV, Gutscheine und Umfragen. Eine Abmeldemöglichkeit findet sich u.a. in jeder E-Mail oder im Mitgliederbereich im eingeloggten Zustand.
Kunden können, wenn sie auf dem jeweiligen Gerät zugestimmt haben, personalisierte oder allgemeine Push-Nachrichten rund um MOTORVISION TV erhalten.
Weitere Einzelheiten zu den jeweiligen Produkten, Kündigungsfristen sowie den aktuellen Inhalten und die Funktionalitäten finden Sie auf https://app.motorvision.tv/product.
Eine Nutzung von „MOTORVISION TV“ kann durch MV International nur ermöglicht werden, sofern das vom Kunden eingesetzte System bestimmte Voraussetzungen erfüllt. Die aktuell gültigen technischen Voraussetzungen unter denen Sie die Produkte nutzen können finden Sie auf https://app.motorvision.tv/howitworks.
Sofern das vom Kunden eingesetzte Endgerät oder System die dort aufgeführten Voraussetzungen nicht erfüllt, ist eine Nutzung von MOTORVISION TV unter Umständen nicht oder nur eingeschränkt möglich.
Eine Rückerstattung des technischen Zugangsentgelts und des Abonnementpreises erfolgt in diesen Fällen nicht. Bitte informieren Sie sich daher vor Abschluss eines Vertrages.
Die Nutzung einiger MOTORVISION TV Produkte ist erst nach Registrierung sowie Abschluss eines entsprechenden Vertrages möglich. Die Einzelheiten zum Vertragsschluss sind in Ziffer 3 geregelt.
Der Kunde ist verpflichtet, sämtliche Angaben im Rahmen der Registrierung wahrheitsgemäß zu machen. Das Kundenkonto wird mit der angegebenen E-Mail-Adresse verknüpft. Der Kunde ist selbst dafür verantwortlich, dass er Zugang zu seinem E-Mail-Account hat und ihm bekannt ist, mit welcher E-Mail-Adresse er sich registriert hat.
MV International ist berechtigt, einzelne Registrierungen auch ohne Angabe von Gründen abzulehnen.
Die personalisierte Vertragsabwicklung, wie die Zusendung von Rechnungen oder Hinweise auf Vertragsänderungen, erfolgt über die vom Kunden hinterlegte E-Mail Adresse. Der Kunde ist selbst dafür verantwortlich, seinen E-Mail-Account regelmäßig auf E-Mails zu überprüfen. Zusendungen im Rahmen der Vertragskommunikation erfolgen nur an E-Mail Adressen, die im Rahmen des Registrierungsprozesses vom Kunden bestätigt wurden.
Eine Registrierung ist ab 16 Jahren möglich.
Die bei MOTORVISION TV angebotenen Inhalte unterliegen lizenzrechtlichen Beschränkungen.
Nicht jeder Inhalt ist aus jedem Land abrufbar
Mit Abschluss der Registrierung (einschließlich des E-Mail-Validierungsprozesses) und dem Anklicken der „Kaufen“-Schaltfläche macht der Kunde MV International ein Angebot zum Abschluss eines entsprechenden Vertrages über den Erwerb eines MOTORVISION TV Produkts im Abonnement. MV International kann dieses Angebot durch übersendung einer E-Mail an die vom Kunden im Rahmen der Registrierung angegebene E-Mail-Adresse annehmen. MV International übersendet dem Kunden in dem Fall eine Bestätigung des abgeschlossenen Vertrages einschließlich der relevanten Informationen. Eine entsprechende Rechnung wird ebenfalls an die E-Mail-Adresse versandt. Vom Entgelt nicht erfasst sind Kosten, die dem Kunden im Zusammenhang mit der Nutzung von „MOTORVISION TV“ aufgrund von Leistungen Dritter entstehen, d.h. insbesondere Kosten für die Nutzung von Endgeräten und die Internetverbindungen. Diese Kosten sind vom Kunden selbst zu tragen.
Wenn nichts Abweichendes geregelt wurde, hat der Vertrag eine Mindestlaufzeit von einem Monat. Danach verlängert er sich automatisch um jeweils einen weiteren Monat, wenn er nicht von einer der Parteien gekündigt wird.
Wenn nichts Abweichendes geregelt wurde, ist eine Kündigung jederzeit mit einer Frist von 30 Tagen möglich. Die Kündigung kann z.B. per E-Mail unter Angabe der E-Mail-Adresse, auf welche das Abonnement gebucht ist, sowie über das Kundenkonto erfolgen. Das Recht zur außerordentlichen Kündigung aus wichtigem Grund bleibt unberührt. Ein wichtiger Grund liegt insbesondere dann vor, wenn eine fällige Zahlung durch den Kunden nicht erbracht wurde.
Das Produkt „PREMIUM“ kann aus lizenzrechtlichen Gründen nur aus ausgewählten Ländern gebucht werden. Das Angebot kann inhaltlich abhängig vom jeweiligen Wohnsitzland variieren oder beschränkt sein.
Bei Abschluss eines kostenpflichtigen Abonnements steht Ihnen das nachfolgende Widerrufsrecht zu:
Sie haben das Recht, binnen vierzehn Tagen ohne Angabe von Gründen diesen Vertrag zu widerrufen. Die Widerrufsfrist beträgt vierzehn Tage ab dem Tag des Vertragsschlusses.
Um Ihr Widerrufsrecht auszuüben, müssen Sie die MV International GmbH, Bahnhofstrasse 20b, 8272 Ermatingen, Schweiz, oder per Fax: 004989122281499, oder per E-Mail: support@motorvision.com mittels einer eindeutigen Erklärung (z.B. ein mit der Post versandter Brief, Telefax oder E-Mail) über Ihren Entschluss, den Vertrag zu widerrufen, informieren.
Zur Wahrung der Widerrufsfrist reicht es aus, dass Sie die Mitteilung über die Ausübung des Widerrufsrechts vor Ablauf der Widerrufsfrist absenden.
Wenn Sie diesen Vertrag widerrufen, haben wir Ihnen alle Zahlungen, die wir von Ihnen erhalten haben, einschließlich der Lieferkosten (mit Ausnahme der zusätzlichen Kosten, die sich daraus ergeben, dass Sie eine andere Art der Lieferung als die von uns angebotene, günstigste Standardlieferung gewählt haben), unverzüglich und spätestens binnen vierzehn Tagen ab dem Tag zurückzuzahlen, an dem die Mitteilung über Ihren Widerruf dieses Vertrages bei uns eingegangen ist. Für diese Rückzahlung verwenden wir dasselbe Zahlungsmittel, das Sie bei der ursprünglichen Transaktion eingesetzt haben, es sei denn, mit Ihnen wurde ausdrücklich etwas anderes vereinbart; in keinem Fall werden Ihnen wegen dieser Rückzahlung Entgelte berechnet.
Ihr Widerrufsrecht erlischt bei einem Vertrag über die Lieferung von nicht auf einem körperlichen Datenträger befindlichen digitalen Inhalten vorzeitig, wenn Sie ausdrücklich zugestimmt haben, dass wir mit der Ausführung des Vertrages vor Ablauf der Widerrufsfrist beginnen und Sie Ihre Kenntnis davon bestätigt haben, dass Sie durch Ihre Zustimmung mit dem Beginn der Ausführung des Vertrages Ihr Widerrufsrecht verlieren. Eine solche Zustimmung erteilen Sie in der Regel im Rahmen des Registrierungsprozesses.
MV International behält sich vor, den Preis für ein Abonnement anzupassen, wenn sich der Produktumfang verändert oder sich unsere Betriebskosten erhöhen. Faktoren hierbei können beispielsweise gestiegene Kosten für die Produktion und die Lizensierung unserer Inhalte, für die Aufrechterhaltung des technischen Betriebes unserer Plattformen sowie im Bereich von Personal und Infrastruktur (z. B. erhöhte Mietkosten) sein; ebenso aber auch gesteigerte staatliche Abgaben. MV International wird die betroffenen Kunden über eine geplante Anpassung mindestens 8 Wochen im Voraus per E-Mail an die hinterlegte E-Mail-Adresse informieren. Sofern der Kunde den Vertrag nicht rechtzeitig vor dem ihm mitgeteilten Termin der Preisanpassung kündigt, gilt der mitgeteilte angepasste Preis ab diesem Zeitpunkt als vereinbart.
Das Entgelt für das jeweilige Abonnement ist vorab fällig. Wir behalten uns eine anteilige Abrechnung (in der Regel monatlich) vor, sodass insbesondere die erste und die letzte Rechnung anteilig erfolgen können.
Wählt der Kunde Lastschrift als Bezahlmethode, so erteilt er hiermit der MV International ein SEPA Basismandat. Der Einzug der Lastschrift erfolgt einen Tag nach dem Rechnungsdatum. Die Frist für die Vorabankündigung (Pre-Notification) wird auf einen Tag verkürzt. Der Kunde sichert zu, für die Deckung des Kontos zu sorgen. Sämtliche Kosten, die aus einer Nichteinlösung oder einer Rückbuchung der Lastschrift entstehen, gehen zu Lasten des Kunden, es sei denn, die Nichteinlösung oder die Rückbuchung wurde durch MV International verursacht.
Kunden haben teilweise die Möglichkeit das Produkt „PREMIUM“ für eine beschränkte Zeit kostenlos zu nutzen. Auf die Details und insbesondere die jeweilige Dauer der kostenlosen Testphase wird auf der Webseite und bei der Buchung hingewiesen. Die Anzahl der kostenlosen Testphasen ist auf eine pro Kunde begrenzt. Das Angebot gilt nur für Neukunden, die noch keine kostenlose Testphase bezogen haben.
Der Kunde ist berechtigt, sich auf bis zu 3 unterschiedlichen mobilen Endgeräten zu registrieren. Sämtliche Videofiles und TV Live-Streams sind mit einem Digital Rights Management („DRM“) versehen, welches die Anzahl an zeitgleichen Streams limitiert und weitere Nutzungsbeschränkungen (z.B. territorial, zeitlich) vorsehen kann. Der Kunde ist verpflichtet, das DRM nicht zu verändern, zu entfernen oder zu umgehen. Weitere Informationen zum DRM sind unter „Verwaltung digitaler Rechte“ abrufbar.
Der Kunde ist zur Nutzung von „MOTORVISION TV“ ausschließlich im privaten Bereich berechtigt und darf die dort angebotenen Inhalte nur zu persönlichen und nicht-gewerblichen Zwecken verwenden. Eine öffentliche Aufführung – gleich welcher Art – ist nicht gestattet.
Die Videofiles und TV Live-Streams sind urheberrechtlich geschützt und dürfen ohne Zustimmung von MV International und den TV-Sendern weder vervielfältigt noch bearbeitet oder an Dritte weitergegeben werden.
Der Kunde ist nicht berechtigt, das Vertragsverhältnis auf andere natürliche und/oder juristische Personen zu übertragen oder diesen nicht die Nutzung seines Zugangs zu gestatten oder zu ermöglichen. Der Kunde ist für die Geheimhaltung seiner Zugangsdaten, inkl. des Passwortes, verantwortlich.
Der Kunde ist verpflichtet, die in „MOTORVISION TV“ enthaltenen Videofiles und TV Live-Streams nicht zu kopieren, an Dritte weiterzugeben und insbesondere in Filesharing-Netzwerken einzustellen oder auf sonstige Weise öffentlich anzubieten oder öffentlich zugänglich zu machen, insbesondere nicht über Webseiten, Blogs, Videoportale o.ä. Unabhängig davon ist das Teilen von Links über Social Media (z.B. Facebook oder Twitter) über die hierfür im Rahmen von „MOTORVISION TV“ bereitgestellten Funktionen gestattet.
Der Kunde ist verpflichtet, Kindern oder Jugendlichen nur solche Inhalte aus „MOTORVISION TV“ vorzuführen oder in sonstiger Weise zugänglich zu machen, die für die jeweilige Altersgruppe freigegeben sind.
Inhalte, die für Kinder und/oder Jugendliche unterschiedlicher Altersstufen nicht geeignet sind, sind mit technischen Alterskennzeichnungen versehen, wodurch die Voraussetzungen für einen sinnvollen Einsatz eines von den zuständigen Behörden anerkannten Jugendschutzprogramms geschaffen werden.
MV International behält sich das Recht vor, Kunden im Falle von Verstößen gegen die in Ziffern 4.1 und 4.2 aufgeführten Regelungen mit sofortiger Wirkung für die Nutzung von „MOTORVISION TV“ zu sperren. Gleiches gilt im Falle eines Zahlungsverzugs.
Bereits entrichtete Entgelte verfallen in diesem Fall und werden nicht zurückerstattet. Nach Zahlung des Entgelts kann die Sperrung wieder aufgehoben werden.
MV International übernimmt keine Garantie und Gewähr dafür, dass MOTORVISION TV den Anforderungen der Kunden entspricht, unterbrechungsfrei, sicher oder fehlerfrei ist. MV International behält sich das Recht vor, einzelne Videofiles – insbesondere aus rechtlichen Gründen – jederzeit aus „MOTORVISION TV“ zu entfernen und/oder im TV Live-Stream zu schwärzen oder durch andere Inhalte zu ersetzen.
MV International und die TV-Sender haften für Schäden im Falle einer schuldhaften Verletzung des Lebens, des Körpers oder der Gesundheit sowie in Fällen vorsätzlicher oder grob fährlässiger Handlungen nach den gesetzlichen Vorschriften.
Die Haftung von MV International und der TV-Sender für Schäden, die aufgrund leichter Fahrlässigkeit verursacht wurden, ist auf wesentliche Vertragspflichten, d.h. solche Pflichten, deren Erfüllung die ordnungsgemäße Vertragsdurchführung überhaupt erst ermöglicht, deren Nichterfüllung den Vertragszweck gefährden würde und auf deren Einhaltung der Nutzer regelmäßig vertraut, beschränkt.
Änderungen dieser Allgemeinen Nutzungsbedingungen werden dem Kunden in geeigneter Weise z.B. per E-Mail mitgeteilt. Widerspricht der Kunde den änderungen innerhalb von 14 Tagen nach Mitteilung, behalten die zum Zeitpunkt des Vertragsabschlusses gültigen Allgemeinen Nutzungsbedingungen solange Gültigkeit, bis das jeweilige Vertragsverhältnis endet. Widerspricht der Kunde den Änderungen nicht innerhalb einer Frist von 14 Tagen nach Mitteilung, werden ab diesem Zeitpunkt die geänderten Allgemeinen Nutzungsbedingungen wirksam und sind von diesem Zeitpunkt an maßgeblich für die Vertragsbeziehung.
Die jeweiligen Allgemeinen Nutzungsbedingungen des vom Kunden gewählten Payment-Dienstleisters finden ergänzende Anwendung zu den hier getroffenen Regelungen.
Sofern der Kunde das Abonnement über einen App-Store, z.B. von Amazon, Google oder Apple gebucht hat, gelten zusätzlich deren abweichende Bedingungen. Die Vertragsbeziehung besteht dann zwischen dem Kunden und dem Store-Anbieter.
Es gilt deutsches Recht unter Ausschluss von UN Kaufrecht. Die etwaige Unwirksamkeit einzelner Bestimmungen dieser Allgemeinen Nutzungsbedingungen berührt die Wirksamkeit der übrigen Bestimmungen nicht.
